Department of Legal Affairs

Role

The Department of Legal Affairs, under the authority of the Minister of State, has the following responsibilities:

  • Preparing draft legislation (Bills)
  • Examining proposals for legislation
  • Monitoring the legislative procedure, and in particular reporting to the National Council
  • Ensuring that laws that are passed are enforced, particularly by submitting the necessary regulatory texts to the competent authorities

This Department, with the assistance of avocat-défenseurs or lawyers, represents the interest of the State before the courts in Monaco and abroad.
It may be consulted, through the compulsory intermediary of the General Secretariat of the Government, on any issue relating to the law or its implementation.
The Department of Legal Affairs does not provide information under any circumstances (by telephone, in writing or by electronic means) to individuals, students, legal officials, researchers, etc.

Organisation and operation

It is composed of three Offices:

  • The Legislative Affairs Section
  • The Disputes Section
  • Human Rights and Fundamental Freedoms Section
