List of processing operations

Management of non-profit organisations - NPOs (Associations, Federations and Foundations)

In accordance with the regulations in force in the Principality of Monaco on protecting personal data, the information gathered in the context of data processing is collected by the State of Monaco / Ministry of Interior, which acts as Data Controller for processing the Management of non-profit organisations - NPOs (Associations, Federations and Foundations)’.

Data processing enables the following functions:

  • Management of records for associations, foundations and federations (creation, amendment, removal)
  • Production of statistics
  • Updating records for each legal entity 
  • Management of members of the administrative body
  • Management of beneficial owners (creation, amendment, removal)
  • Management of those responsible for basic information and information on beneficial owners (creation, amendment, removal)
  • Management of the risk level of the NPO within the scope of the FATF
  • Management of the storage location for registers of non-profit organisations
  • Management of activities carried out by non-profit organisations
  • Traceability of operations on the register

Data processing is necessary for reasons of public interest and to comply with the legal and regulatory obligations governing non-profit organisations and the AML/CFT system:

Data processed as part of the data processing functions is accessible to authorised personnel of the Prince’s Government (Ministry of Interior, and as part of its maintenance duties, the Information Technologies Department). The information is never shared for commercial or advertising purposes.

Furthermore, as part their role in the fight against money laundering, the financing of terrorism and proliferation of weapons of mass destruction and corruption (as governed by Act 1.362 of 3 August 2009, amended), the relevant AML/CFT authorities have the right to access all data in the register for the purposes of consultation.

This access is governed by the following legislation, which defines the exhaustive list of the relevant authorities:

Some information is compulsory. Failure to provide the compulsory information may prevent the processing of applications in connection with the NPO.

With regard to any indirect data collection (beneficial owners, points of contact, etc.), the person entering personal data concerning a third party agrees to notify the data subjects in accordance with the legislation applicable in the Principality of Monaco.

In accordance with the applicable legislation on protecting personal data, data subjects have a right of access to their personal data and the right to request that inaccurate, incomplete or outdated data be corrected, updated or deleted.

To exercise these rights or for any enquiries concerning the processing of their personal data within the framework of the site, each data subject may make a written request:

To ensure that the response remains confidential and that we are replying only to the person whose data is involved, proof of identity, in black and white, may be requested from the applicant in case of any doubt about the identity of the data subject. The information will be disclosed to the data subject within one month of the request.

Individuals who have exercised their rights but feel, after contacting the Government, that their rights have not been respected, can submit a complaint to the Data Protection Authority of Monaco (APDP): www.apdp.mc.
