Principle

The State of Monaco / Driver and Vehicle Licensing Office, in its capacity as data controller, uses and implements the following personal data processing in accordance with its statutory duties under applicable laws and regulations.

Processing of personal data involves the collection of user data, making it possible to identify users (e.g. surname, first name, business email address) or to make them identifiable (e.g. connection log).

It is carried out in accordance with the Driver and Vehicle Licensing Office’s statutory duties under Sovereign Ordinance no. 13.637 of 25 September 1998 establishing the Driver and Vehicle Licensing Office. This processing is carried out in accordance with the regulations of the Act no. 1.565 of 3 December 2024 on the protection of personal data.

The Driver and Vehicle Licensing Office processes personal data in the public interest, for the following purposes:

  • Performing its statutory duties under Sovereign Ordinance no. 1.691 of 17 December 1957 regulating the traffic police (Highway Code) 
  • Drafting and enforcing regulations governing motor vehicles, registration certificates, driving licences and transport industry professionals’ licences 
  • Operating the Vehicle Testing Centre 
  • Helping to make road safety policy by suggesting actions designed to prevent risks and inform and educate users 
  • Advising and making recommendations on laws and regulations governing motor vehicles, driving licences, road transport, and urban mobility, and maintaining relations with organisations specialising in road transport and road safety

Personal data is used for specific objectives, each referred to as a "purpose" in accordance with Monegasque data protection laws. In the course of its duties, the Driver and Vehicle Licensing Office uses personal data for the following purposes.

Exercising rights

In accordance Articles 10 et seq. of the Act no. 1.565 of 3 December 2024 on the protection of personal data, every data subject whose personal data is used by the Driver and Vehicle Licensing Office has:

  • A right to access (Article 12
  • A right to rectification (Article 13
  • A right to limitation (Article 15
  • A right to object, in cases where the data processing is based on a reason of public interest or necessary to pursue a legitimate interest (Article 17
  • A right to data portability (Article 18)

Where personal data is processed for scientific or historical research or statistical purposes, the data subject has the right to object to the processing on grounds relating to their particular situation, unless the processing is necessary for the performance of a task carried out in the public interest by a private legal person appointed for that purpose, providing a public service under contract, or exercising public authority vested in the data controller.

To verify their identity, but only where there is reasonable doubt, they may be asked to provide a black and white copy of an identity document that includes a photograph.  The copy of the identity document is destroyed once the request is processed.

Only the data subject is entitled to ask for access to their personal information, except in certain specific circumstances (e.g. if the data subject has died). 

Once the request has been received, the data concerned will be provided within one month.

Data subjects may refer the matter to the Personal Data Protection Authority if they consider that the Government has not complied with its commitments regarding exercising rights.

Primary purpose of processing: "User management"

For administrative purposes, the State of Monaco / Driver and Vehicle Licensing Office, as the data controller, processes personal data in accordance with its duties under applicable laws and regulations.

The primary purpose of this processing is to: "centralise how users of the Driver and Vehicle Licensing Office are managed, to create a database to facilitate the handling of administrative requests submitted to the Office".

The secondary purposes are as follows:

  • Managing interactions with users
  • Creating an administrative database for processing users’ specific requests relating to:
    • Vehicle registration
    • Driving licences
    • Passenger and merchandise transport
    • Technical inspection of vehicles
    • Reimbursement of fees paid to the Driver and Vehicle Licensing Office

Data from a sample of cases are retained indefinitely for historical purposes

Data collected for the above purposes (with the exception of information marked as optional) are mandatory and essential for accessing the services provided by the Driver and Vehicle Licensing Office. If this information is not provided, the Office will be unable to process the user’s request.

Access to data is restricted to the following:

  • Civil servants and officials at the Driver and Vehicle Licensing Office, where acting in the course of their official duties, may enter, amend, update, and view the data provided
  • The Police Department may view and transmit the data provided in the course of its appointed duties
  • The Information Technologies Department and authorised external service providers acting on its behalf have full rights of access for the purpose of maintaining applications and related developments, and for monitoring and maintaining security measures for the State’s information systems and website
  • The Digital Services Department, and authorised external service providers acting on its behalf, have full rights of access for the purpose of providing project management support
  • The "Direction des Services Judiciaires" (Monegasque Department of Justice) may transmit the data provided in the course of its appointed duties
  • The Department of Tax Services may transmit the data provided in the course of its appointed duties
  • Monaco Financial Security Authority may transmit the data provided in the course of its appointed duties
  • The Business Development Agency may transmit the data provided in the course of its appointed duties

The information will not be communicated for commercial or advertising purposes.

Data collected for the primary processing purpose are also used for further processing, for the secondary purposes listed below.

Processing operation: "Managing vehicle registration applications and records"

For the administrative management of registration applications and records for vehicles registered in the Principality of Monaco, the State of Monaco / Driver and Vehicle Licensing Office, as the data controller, processes personal data in accordance with its duties under applicable laws and regulations

The primary purpose of this processing is to: "manage vehicles registered in Monaco and issue related licences".

The secondary purposes are as follows:

  • Maintaining the vehicle registration system
    • Managing vehicles registered in the Principality of Monaco (Deliberation no. 2011-59)
    • Reporting the loss or theft of a registration certificate online(Deliberation no. 2023-176)
    • Routine communication with motor industry professionals
    • Maintaining the register of identification plates for chauffeur-driven vehicle operators
  • Maintaining the register of temporary registrations
    • Maintaining the register of third parties authorised to provide vehicle registration services (dealerships, etc.)
    • Registering demonstration vehicles
  • Annual vehicle registration renewals (stamps)
  • Maintaining the register of plate orders

Processing operation: "Driving licence management"

For the administrative management of registration applications and records for vehicles registered in the Principality of Monaco, the State of Monaco / Driver and Vehicle Licensing Office, as the data controller, processes personal data in accordance with its duties under applicable laws and regulations.

The primary purpose of this processing is to: "issue driving licences to residents of the Principality who have demonstrated or provided evidence of their competence to drive safely".

The secondary purposes are as follows:

  • Maintaining the register of driving licences (managing bans and suspensions, issuing copies of lost or stolen licences, international licences, renewals, withdrawing licences due to the holder being unfit to drive)
  • Exchanging driving licences issued in other jurisdictions
  • Managing driving tests
    • Managing candidate applications
    • Managing driver and vehicle licence examinations (specifically "database of driver and vehicle licence examinations") (Deliberation no. 2013-41)
    • Scheduling driving tests online (specifically "viewing driving test slots") (Deliberation no. 2013-42)
    • Routine communication with driving schools
    • CCTV monitoring of the driving theory test room

Access to these data is restricted to civil Servants and officials at the Driver and Vehicle Licensing Office acting in the course of their official duties. The data are not shared with anyone else. 

Processing operation: "Passenger and goods transport"

For the administrative management of registration applications and records for vehicles registered in the Principality of Monaco, the State of Monaco / Driver and Vehicle Licensing Office, as the data controller, processes personal data in accordance with its duties under applicable laws and regulations.

The primary purpose of this processing is to: "issue and monitor administrative documents allowing road transport of passengers and goods in accordance with applicable laws and regulations and international agreements".

The secondary purposes are as follows:

  • Maintaining the transport register
    • Authorising international road transport
    • Maintaining the register of transport operators
    • Authorising the use of auxiliary vehicles by chauffeur-driven service operators
  • Maintaining the register of transport professionals
    • Land-based medical transport
    • Professional licence
    • Driving instructors and examiners
    • Tachograph cards

Processing operation: "Technical inspections"

For the administrative management of registration applications and records for vehicles registered in the Principality of Monaco, the State of Monaco / Driver and Vehicle Licensing Office, as the data controller, processes personal data in accordance with its duties under applicable laws and regulations.

The primary purpose of this processing is to: "ensure that land vehicles registered in the Principality of Monaco are properly maintained, in good working order, and used safely and in compliance with environmental standards on public roads"

The secondary purposes are as follows: Managing the technical inspection of vehicles (administratively and technically) (Deliberation no. 2020-47)

This processing is part of the Driver and Vehicle Licensing Office’s appointed duties and its lawful basis is the public interest, and the consent of the data subjects where applicable, as required by the following legal instruments:

The data used in this processing activity are collected via the primary processing activity “User Management”, outlined above. These data are processed and stored in exactly the same way as data collected for the primary processing purpose, with the same access restrictions and recipients.

Processing operation: "Financial processing and refunding fees paid to the Office"

For the administrative management of registration applications and records for vehicles registered in the Principality of Monaco, the State of Monaco / Driver and Vehicle Licensing Office, as the data controller, processes personal data in accordance with its duties under applicable laws and regulations.

The primary purpose of this processing is to: "manage requests for refunds of fees paid to the Office, and to ensure the traceability of the related financial transactions".

The secondary purpose is to: allow requests for refunds of fees paid to the Office to be handled electronically. (Deliberation CCIN 2023-077)
