Principle
The Department of Employment in its capacity as data controller, uses and implements the following personal data processing in accordance with its duties as set out in the regulatory provisions.
Processing of personal data by the Department of Employment involves the collection of user data, making it possible to identify users (e.g. surname, first name, business email address) or to make them identifiable (e.g. connection log).
In accordance with the duties entrusted to the Department of Employment (Sovereign Ordinance no. 16.675 of 18 February 2005 establishing the Department of Employment) or, where applicable, a legitimate interest, this data is required when pertaining to:
- Studying and drawing up draft legislation and regulations in the field of employment law
- Applying employment legislation and regulations
- Monitoring the application of international employment law conventions
- Monitoring, in all industrial, commercial, and small-scale establishments, the application of legal and regulatory provisions concerning working conditions and the protection of workers in the areas of health, safety and hygiene
- Informing employers and employees about the status of employment legislation and regulations and how they are applied
- Implementing consultation and collective bargaining between social partners
- Information, guidance, monitoring and placement of jobseekers
- Issuing work permits and employment authorisations, with prior assurance from the Police Department in compliance with the provisions of Article I-2 of Sovereign Ordinance no. 765 of 13 November 2006, amended, that the job seeker is not likely to be a threat to public order
- The allocation and payment of recruitment subsidies
- Monitoring compliance with legislation on conditions of recruitment and termination of employment
- Managing the unemployment compensation scheme
- Statistical and analytical studies on the employment market and its prospects
- Any other tasks relating to employment with which it is entrusted
Therefore, each use of this personal data has a purpose, referred to as the "purpose" under Monegasque regulations on the protection of personal data. As part of its work, the Department of Employment processes users' personal data for the following purposes.
Processing operation: "Hiring domestic staff via virtual recruitment processes"
As part of the Employment Portal Programme aimed at improving and modernising support for employees' career development in the Principality of Monaco, the Department of Employment in its capacity as data controller, uses and implements the following personal data processing in accordance with its duties as set out in the regulatory provisions.
This processing falls within the remit of the Employment office - Department of Employment and is warranted on the grounds of public interest and the consent of those concerned, in accordance with the following provisions:
- Act no. 629 of 17 July 1957 regulating the conditions of recruitment and dismissal in the Principality
- Sovereign Ordinance no. 16.675 of 18 February 2005 establishing the Department of Employment
The data collected as part of the aforementioned processing is compulsory and essential for users to gain access to the services offered by the Department of Employment as part of said processing.
Users will not be able to access these services without gathering this data.

In order to verify the applicant's identity, and only in cases of reasonable doubt, the applicant may be asked to provide a black and white copy of a photo ID document. The copy of the identity document will be deleted once the application is closed.
Except in certain cases (e.g. if the person to whom the information relates is deceased), only the person concerned may request the information.
The information will be provided within one month of receipt of the request.
Data subjects may refer the matter to the relevant data protection authority if they consider that the Government has not complied with its commitments regarding exercising rights.
Processing operation: "Enabling job seekers and employers to be monitored as part of the employment search process"
As part of the Employment Portal Programme aimed at improving and modernising support for employees' career development in the Principality of Monaco, the Department of Employment in its capacity as data controller, uses and implements the following personal data processing in accordance with its duties as set out in the regulatory provisions.
This processing falls within the remit of the Employment office - Department of Employment and is warranted on the grounds of public interest and the consent of those concerned, in accordance with the following provisions:

The information processed as part of the Job Seekers and Employers Portal features is intended for use by authorised staff of the Department of Employment. The Administration will not disclose this information to third parties, except where required by law.
The support departments (Digital Services Department and Information Technologies Department) of the Prince's Government may have access to information within the strict framework of the duties entrusted to them.

Some of the personal information collected is compulsory (e.g. surname, first name) and is required, both to process the data and to respond to any request or queries from the person concerned. Access to the Job Portal will not be granted if the compulsory information on the data collection forms is not provided (information followed by an asterisk *).

This processing falls within the remit of the Employment office - Department of Employment and is warranted on the grounds of public interest and the consent of those concerned, in accordance with the following provisions:

The support departments (Digital Services Department and Information Technologies Department) of the Prince's Government may have access to information within the strict framework of the duties entrusted to them.

As part of the Employment Portal Programme aimed at improving and modernising support for employees' career development in the Principality of Monaco, the Department of Employment in its capacity as data controller, uses and implements the following personal data processing in accordance with its duties as set out in the regulatory provisions.
This processing falls within the remit of the Employment office - Department of Employment and is warranted on the grounds of public interest and the consent of those concerned, in accordance with the following provisions:

The information processed is collected indirectly following notification of the accident to the Labour Inspectorate by the Police Department, in accordance with Act no. 636 of 11 January 1958.
The information collected as part of this processing is intended solely for use by authorised personnel from the Department of Employment/Labour Inspectorate, Monaco Social Security Funds and the Office of Occupational Medicine for the purpose of monitoring accidents at work and occupational illnesses among employees in the Principality of Monaco, in accordance with the applicable provisions.
The support departments (Digital Services Department and Information Technologies Department) of the Prince's Government may have access to information within the strict framework of the duties entrusted to them.
