Landlords of premises for residential use (built before 1 September 1947) and subject to a specific law must comply with a specific letting procedure.
Understanding the process
Owners of residential properties (built before 1 September 1947) which come under the
must respect the rent procedure instituted by article 3 of theA declaration of vacancy must be made within 8 days of vacating the property. At the same time, or when the property is occupied once again, a rental declaration or a declaration of free accommodation must be made.
Accommodation under Act 887 is not advertised in the Official Journal of Monaco and can only be rented to benefit:
- Ascendant or descendant relatives, or the spouse, their partner in a contract between common-law partners or their cohabitant in a cohabitation contract, of the landlord or his/her spouse, his/her partner in a cohabitation contract or his/her cohabitant
- Individuals of Monegasque nationality
- Individuals who have lived in Monaco for at least five years and who have exercised professional activity there for at least six months
- Individuals who have worked in Monaco for at least five years
When making a rental declaration, you must provide the following documents concerning the tenant
- Individuals of Monegasque nationality:
A certificate of nationality issued by the Town Hall - Ancestors or descendants (and their spouses) of the owner or their spouse:
Any documents giving proof of relationship - Individuals who have lived in Monaco for at least five years and who have exercised professional activity there for at least six months:
A certificate of the applicant's residence in the Principality, issued by the Police Department (dated within the past three months)
Any document giving proof of professional activity in the Principality (dated within the past three months) - For a person who has been working for at least 5 years:
Any document giving proof of professional activity in the Principality (dated within the past three months)
You can declare the vacancy, rental or occupancy in free accommodation of your property online by using the online service: "Making a declaration concerning housing under Act No. 887".
For all vacancy declarations, rental or occupancy in free accommodation, you should complete the form:

- Or collect it from the Housing Department
You must complete the "Déclaration de location" form and send it to the Housing Department, accompanied by proof demonstrating how the beneficiary satisfies the conditions required to rent the aforementioned property, pursuant to article 3 of the aforementioned act.
