"Contrat habitation-capitalisation"

Principle

A "habitation-capitalisation" contract enables you to acquire life tenancy of a state-owned apartment on repayment of a loan from the Monegasque State.

You can pay the contract price in full at the time of signature. By paying a minimum contribution of 10% of the price.

This rate is calculated by adding one point to the Euribor 12 months rate on the first working day of November of the current year. It may not exceed 3% nor fall below 1%.

A Ministerial Decree sets the annual percentage rate which will apply during the forthcoming calendar year.

For the period from 1 July to 31 December 2017 only, the rate is set at 1%.

The payments are made by fixed-rate instalments spread over variable maximum terms, i.e. 10 years, 15 years, 20 years, 25 years or 30 years. The "habitation-capitalisation" contract is established for a period of 75 years, at the end of which you can renew it.

On the death of the titleholder, the benefit of the "habitation-capitalisation" contract is passed to his or her spouse and descendantsof Monegasque nationality. You have the option of cancelling the contract and obtaining a capital payment corresponding to the sums invested in the contract.

The "habitation-capitalisation" contract is not applicable to certain dwellings:

  • Apartments or buildings that are to be demolished, renovated or extended
  • Dwellings that are part of the social housing stock

 

Conditions

Before signing the "habitation-capitalisation" contract, you must clear all your housing debts with the the State Property Authority

In order to sign the "habitation-capitalisation" contract, you must:

  • Pay the amount of the "habitation-capitalisation" contract at the time of signing or according to the terms agreed
  • Use and occupy the accommodation yourself and pay the rental charges
  • Repair any damage and cover any losses or prove that you did not cause them
  • Pay for the day-to-day running costs of the accommodation and for any damage, unless it is due to dilapidation, defects, building defects or exceptional circumstances
  • On termination of the contract, you must leave the premises in the condition in which you found them when you took possession
  • Insure your dwelling and provide proof of this insurance when you sign the contract, and then annually, at the request of the State

 

Amount

The price of the contract is calculated on the basis of the average rent for the building per square metre and according to the coefficients for the floor and the location of your apartment.
